Data Privacy Policy

In compliance with Republic Act No. 10173 or the “Data Privacy Act of 2012”, Bizmates Philippines, Inc. endeavors to protect data that we process against unauthorized use or disclosure. Below details the COMPANY’s manner of collecting data, the purpose why data is being collected, how data is transferred, secured, and made accessible to the data owner:

Collection of Personal Data/Information

Bizmates Philippines Inc. collects personal data and/or information of our users (i.e., trainers, applicants, clients and personnel) through the company’s platform by having them register to our websites. In so doing, a user profile is auto-generated to provide an avenue for providing information and uploading documents containing personal information. These validated submissions are essential for us to provide quality service. We also collect information upon users’ access to our platform which may include, among others, recording of lessons and gathering feedback about our services. Such data or information may include the user’s name, address, e-mail address, contact number/s, and other personal and sensitive information.

Purpose of Personal Data/Information Collection

The personal data and/or information gathered by the company may be used to establish a relationship and to enable the company to communicate with its users; to provide, develop, implement and manage the company’s services; to manage and promote Bizmates Philippines Inc.’s business activities and services; to comply with the requirements imposed by applicable laws; to pursue the legitimate interests of the company, or by a third party or parties to whom the data and/or information is disclosed, except where such interests are overridden by fundamental rights and freedoms of the user, which require protection under the Philippine Constitution; and for other purposes directly relating to any of the above.

Transfer of Personal Data

As part of our data privacy policy, all data and/or information collected by the company will be strictly kept confidential. However, subject to the provisions of any applicable law, we may share users’ personal data and/or information with the appropriate officers and/or personnel of our parent and affiliate companies (which may be located within and/or outside the Philippines), as well as contractors or third-party service providers who provide administrative, marketing, telecommunications, data processing or other services.

Such data and/or information may also be shared to any government and/or regulatory authorities if we are under a duty to disclose or share such personal data and/or information in order to comply with any legal obligation, to protect our rights, property, or safety and those of our clients.

Security of Information

We will make all reasonable and appropriate security measures to ensure that all personal data and/or information gathered and under our control are protected against unauthorized access, collection, use, disclosure, copying, modification, disposal or similar risks. The security measures shall aim to maintain the availability, integrity, and confidentiality of personal data and/or information, and are intended for the protection of personal data and/or information against any accidental or unlawful destruction, alteration, and disclosure, as well as against any other unlawful processing.

We will maintain and regularly review the systems and processes through which we manage personal and sensitive information and strive for the continuous improvement thereof by performing privacy impact assessments and internal compliance checks and audits.

Access to your information, correction and other queries

You have the right to reasonable access of your personal data and/or information under our control, including the manner in which we have obtained, used and disclosed such data and/or information.

You also have the right to dispute the inaccuracy or error in the personal data and have the data protection officer correct it immediately and accordingly, unless the request is vexatious or otherwise unreasonable.

Subject to the legal grounds provided under the law and pertinent regulations, you also have the right to request us to suspend, withdraw, or order the blocking, removal, or destruction of your personal data. For any damages sustained due to inaccurate, incomplete, outdated, false, unlawfully obtained or unauthorized use of personal data, you have the right to be indemnified, taking into account any violation of your rights and freedoms as a data subject, as provided by law. You also have the right to lodge a complaint with the National Privacy Commission.

PERSONAL DATA/INFORMATION RETENTION AND DESTRUCTION

Bizmates shall not retain Personal Data longer than necessary or allowed for any other legal, regulatory, or business purposes. Notwithstanding the termination of your contract, however, Bizmates shall be entitled to retain your Personal Data in accordance with Bizmates’ records management and data retention policies for as long as necessary and for the following purposes:
  • for the fulfillment of the purposes for which the data was collected;
  • for the establishment, exercise, or defense of Bizmates’ legal claims;
  • for the furtherance of Bizmates’ legitimate business purposes; and
  • for compliance with applicable laws and regulations.
When the necessity for processing or retention of your data ceases to exist as provided for under the Data Privacy Act, Bizmates shall also accordingly proceed with the destruction of your data in a secure manner. Unless retained for purposes allowable by law, you may also request, in writing, for such Personal Data to be destroyed.

AMENDMENTS AND UPDATES

From time to time, we may amend or update our Data Privacy policy to comply with changes in law, rules, and regulations and for any other legitimate business purpose. You agree to be bound by the prevailing terms of this Policy and its updates, upon the amendment or update being published on our website or through any other manner by which such update or amendment was advised to you. Should the law or rules require, we will obtain your updated consent as to these amendments and changes.

To the extent necessary, information relating to security incidents or personal data breaches shall be reported to related parties through the channels abovementioned and/or through any other manner as established by our company policies.
